Gym Terms and Conditions

These Terms and Conditions (“Terms”) apply to all members and users of Nordic Power Gym Ltd, located at Unit 3 Foundry yard, Honiton, Devon, EX14 1LA (“we”, “us”, “our”). By joining or using our facilities, you agree to be bound by these Terms.
1. Membership
1.1 Membership is open to individuals aged 16 years or over. Proof of age may be required.
1.2 Memberships are non-transferable and may only be used by the named member.
1.3 We reserve the right to refuse or terminate membership where behaviour breaches these Terms.
2. Types of Membership
2.1 We offer the following membership types:
Monthly rolling
Fixed-term (e.g. 6 or 12 months)
Pay-as-you-go
2.2 Membership benefits vary by type and are detailed at the time of joining.
3. Fees and Payments
3.1 Membership fees are payable in advance by Direct Debit/Card.
3.2 All fees are inclusive of VAT unless stated otherwise.
3.3 If a payment fails, we may suspend access until the balance is cleared.
3.4 We reserve the right to increase fees with at least 30 days’ written notice.
4. Cancellation and Termination
Monthly Memberships
4.1 Monthly memberships may be cancelled with 30 days’ notice in writing.
Fixed-Term Memberships
4.2 Fixed-term memberships cannot be cancelled early except in the following circumstances:
Long-term illness or injury (with medical evidence)
Relocation more than 25 miles from the gym
Other exceptional circumstances at our discretion
Cooling-Off Period
4.3 You have the right to cancel within 14 days of joining if the contract was agreed online or off-premises, in accordance with consumer law.
5. Use of Facilities
5.1 Members must follow all gym rules, signage, and staff instructions.
5.2 Appropriate gym attire and footwear must be worn at all times.
5.3 Equipment must be used correctly and returned after use.
5.4 We may restrict access to certain areas or equipment for safety or maintenance.
6. Health and Safety
6.1 You confirm that you are physically able to participate in exercise.
6.2 You should consult a medical professional before starting any exercise programme if you have health concerns.
6.3 We are not responsible for injury caused by misuse of equipment or failure to follow instructions.
7. Personal Belongings
7.1 We are not responsible for loss, theft, or damage to personal belongings unless caused by our negligence.
8. Liability
8.1 Nothing in these Terms limits or excludes our liability for:
Death or personal injury caused by our negligence
Fraud or fraudulent misrepresentation
8.2 Subject to the above, we are not liable for:
Losses not reasonably foreseeable
Indirect or consequential losses
9. Conduct
9.1 We operate a zero-tolerance policy towards:
Harassment or abusive behaviour
Discrimination
Damage to property
9.2 Breach of this policy may result in immediate termination of membership without refund.
10. Classes and Personal Training
10.1 Classes are subject to availability and may be changed or cancelled with reasonable notice.
10.2 Personal training sessions must be cancelled with at least 24 hours notice or may be forfeited.
11. Privacy and Data Protection
11.1 We process personal data in accordance with UK GDPR and the Data Protection Act 2018.
11.2 Our Privacy Policy explains how your data is collected and used.
12. Changes to Terms
12.1 We may update these Terms from time to time.
12.2 Members will be notified of significant changes in advance.
13. Governing Law
13.1 These Terms are governed by the laws of England and Wales.
13.2 Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
